The Angolan patent legislation currently does not make provision for the filing of PCT applications and therefore does not set out the filing requirements for such applications. Accordingly, at present, we propose lodging the same documents as for non-PCT applications and further lodge copies of the International publication, International Search Report and Written Opinion and/or the International Preliminary Report on Patentability.

Filing Requirements:

Convention application:

  • Title and abstract in Portuguese (required on day of filing);
  • English Specification, claims, abstract and drawings (required on day of filing)
  • Verified Portuguese translation of specification, claims and drawings (to be filed as soon as possible after filing date)
  • Power of Attorney with Portuguese translation, notarized & legalised up to Angolan Consulate (to be filed within 60 days of publication)
  • Assignment of Invention with Portuguese translation, notarized & legalised up to Angolan Consulate (to be filed within 60 days of publication)
  • Certified priority document with Portuguese translation, notarized & legalised up to Angolan Consulate (to be filed within 60 days of publication)

PCT National phase application (in addition to above documents):

  • Published PCT application (required on day of filing)
  • International Search Report and Written Opinion and/or International Preliminary Report on Patentability (no set deadline)

Novelty:  Absolute novelty is required 

Patentability:  Food, pharmaceuticals and chemical products and medicines intended for human and animal use are not patentable (but processes or apparatus for their manufacture are patentable)

Excess Fees:  None

Examination:  As to form only

Term of Patent:  15 years from the effective filing date

Renewals:  Payable annually in advance from the first anniversary of the effective filing date
