South Africa is a member of the
Paris convention and priority
may be claimed if the South
African trademark registration
is filed within six months from
the filing of a corresponding
foreign trademark application in
a convention country. South
Africa is not yet a member of
the Madrid Protocol. Indications
were that South Africa would
have joined in 2008 but there
has to date been no finality on
this. As a general rule, South
African trademark law is very
similar to the trademark laws of
the United Kingdom.
